(1) These General Terms and Conditions (GTC) apply to all contracts between the operator of the BlueMovieHub platform (hereinafter "Provider") and the user (hereinafter "Customer") for the use of the platform.
(2) Deviating terms of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.
(3) The current version of these GTC is available on the platform.
(1) BlueMovieHub is a platform that enables content creators to create and monetize digital content (images, videos, livestreams).
(2) Fans can purchase Coins through the platform to access paid content, unlock messages, or send gifts.
(3) The Provider provides the technical infrastructure and mediates between creators and fans. The Provider is not a contractual party to contracts concluded between creators and fans.
(1) Using the platform requires registration. The user must be at least 18 years old and confirm this during registration.
(2) The user is obligated to provide truthful information and keep their access data secret. The user is responsible for activities under their access data.
(3) Each user may only maintain one account. Sharing accounts or passing on access data is prohibited.
(4) The Provider reserves the right to reject registrations without giving reasons.
(1) Coins are a virtual currency that can only be used on the platform. The exchange rate is 100 Coins = 1 Euro.
(2) Coins are non-transferable and cannot be exchanged back to real money by fans. Creators are exempt per § 5.
(3) Coin packages can be purchased through the offered payment methods. Prices include statutory VAT.
(4) Unused Coins do not expire as long as the user account is active.
(1) Creators can request a payout of their balance from a minimum amount of 5,000 Coins (equivalent to 50 Euro gross).
(2) A platform fee of 20% is retained from each payout. The remaining 80% is paid out to the creator.
(3) Complete tax-relevant data (name, address, tax ID if applicable) is required for payouts.
(4) Payouts are made to the bank account specified by the creator. Processing time is typically 5-10 business days.
(5) Creators are responsible for properly taxing their income.
(1) Creators are responsible for their uploaded content and guarantee that they possess all necessary rights to the content.

(3) The Provider reserves the right to remove content without notice and to block user accounts when violations are detected.
(1) For digital content, the right of withdrawal expires upon commencement of execution if the consumer has expressly agreed and confirmed their knowledge of the loss of the right of withdrawal.
(2) By purchasing Coins, the customer agrees to immediate provision and confirms knowledge of the expiration of the right of withdrawal.
(3) Already redeemed Coins or unlocked content cannot be refunded.
(1) The user can delete their account at any time through account settings. Remaining Coin balance for fans is forfeited upon deletion.
(2) In case of violations of these GTC or terms of use, the Provider may block or delete the user account without prior notice.
(3) In case of a justified account suspension due to violation of platform rules, the balance is forfeited.
(4) The Provider reserves the right to permanently prohibit blocked users from re-registering.
(1) The Provider is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
(2) In case of slight negligence, the Provider is only liable for breach of essential contractual obligations, limited to foreseeable, typically occurring damage.
(3) The Provider is not liable for creator content, behavior of other users, or platform availability.
(1) The Provider reserves the right to change these GTC at any time with effect for the future.
(2) Changes will be communicated to users at least 14 days before taking effect by email or through the platform.
(3) If the user does not object within 14 days of receiving the notification, the amended GTC are deemed accepted.
(1) The applicable law is determined by the Provider's registered office and will be announced here after business registration.
(2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
(3) The contractual language is German.
